The Story of Drones attack had begun in Pakistan during the reign of Former Pakistani President & Dictator Pervez Musharraf who made a secret deal to United States for allowing a drones attack on his own request .He admitted the fact during his interview with CNN on very  first time on mainstream media.Where foreign aliens are allowed to pondered native Civilians under auspicious of Musharraf regime.It is also a first time that any Pakistani official has publicly accepted his permission for drone strikes despite innumerable times of denials  by himself previously (1,2). Blatant and unfolded lies of Musharraf for a few Drones attack exposed laterally when US drones strike converted into double to triple  figures for nearly 14 long years .(3 )

According to IDMC figure approximately 106,000 people were internally displaced during the war on terror as a consequences of US fatal strikes upon civilians as well as barbaric military operations of Pakistan Army (9)

 

Roughly 62.638 Pakistanis people had wounded who had nothing to do with any sort of terrorism during US so called war on terror (10).Amass of wounded were suffered in broken bones, shrapnel wounds, brain injuries, spinal cord injuries, nerve damage, paralysis, loss of sight and hearing, post-traumatic stress disorder (PTSD), and limb loss. 

 

Pakistan worst decision for US made a collateral damage in Pakistan.What Pakistan gained was far less than what Pakistan lost.US Intimateded Musharaff with these words.

 "The Bush hubris administration threatened to bomb Pakistan "back to the stone age" after 9/11 if Pakistan did not cooperate with American on his terms against Taliban regime in Afghanistan.

He spilled the beans during his interview aired on CBS Television .He said that threat was delivered by former Deputy Secretary of State  "Richard Armitage" in talking with Pakistan's intelligence director.

"The intelligence director told me that (Mr Armitage) said, 'Be prepared to be bombed. Be prepared to go back to the stone age',"(11,12)

Responding to allegations former Deputy Secretary of State denies such threatening to Pakistan after 9/11 he said that his remarks had been misrepresented.Whatsoever the circumstances were but it led to massive carnage inside Pakistan of no winning war.(13).

Due to the war on terror Pakistan's budget massively escalated up graph.Pervez Musharraf's bank accounts filled up affluence with pool of wealth.NAB has received a fresh evidence in its probe against former dictator Pervez Musharraf who had been involved in misusing of authority & illegal allotment of multiple expensive plots to his favorite officers worth about Rs1000 Billion and this is  how Mr Clean became a billionaire.(14,15).

Fugitive Musharraf was tried for high treason stemming from his actions on 3 November 2007 when he subverted and suspended the Constitution of Pakistan,(16) Musharraf slipped out of Pakistan after the deal with the government & escaped a luxury villa in Islamabad due to the fear of his arrest and sentence to death.(17)

 

How does Musharraf own over Rs2 billion deposits?

 Musharraf, who retired as army chief, till recently was in possession of around Rs 2156 million net cash in his offshore bank accounts besides other movable and immovable property, but in his official papers submitted with the Election Commission, he declared that his worth is mere Rs 626 million (18)

But one cable from Patterson written in October 2009 noted with satisfaction, “The Pakistani Army has for just the second time approved deployment of U.S. special operation elements to support Pakistani military operations. Pakistan's People's Party Former Prime Minister Yousaf Raza Gillani assured U.S that

Former (PTI) Prime Minister Imran khan was the only leader who didn't only protest to halt the drone strikes in Pakistan but also pushes ultimatum to U.S for counter-strike against U.S aggression if she persist strikes against the violation of  state sovereignty. (32,33)

Obama's Secretary of Defense Leon Panetta referred to the drones "As the only game in the town "(45).Leon Panetta described American's war on terror as the most precise campaign in the history of warfare (46).

According to New America Foundation documents that the country suffered 414 drone attacks between JUNE 2004 December 2018, of these a whopping 353 were under the Obama administration alone.In 2010, 128 drone strikes were recorded.Between 2.366 & 3,702 terrorists & civilians perished in these drone attacks.Among these,245 to 303 were confirmed civilians (47).

CNN identified covert drone strikes as one of Obama's key national security politicizes,nothing he had authorized 283 strikes in Pakistan six times more than the number during President George.W.Bush's eight years in office (48,49)

People such as Nobel laureate Desmond M. Tutu declared that these weapons undermined America’s “moral standards,” and non-governmental organizations such as Airways (52)

It was troubling to see that United State consistently using a vicious force against the territorial sovereignty of a nation that is officially proclaims an important ally in war against terror (53). When the Pakistan army was forced to act against tribal militias within its own borders in the Federally Administered Tribal Areas (FATA) under us directives it found itself fighting and unpopular war against a segment of its own population (54). Relentless drone strike carried out by the US in FATA region which have killed scores of innocent civilians,including children, women are presented as proof substantiate such claims by foreign extremists.(55). In reality the United States is bombing such areas,albeit quite recklessly with the aim of neutralizing the Taliban members and foreign elements (56).

When Tribes of Waziristan heard of the atrocities being committed against the Muslims Population by the Hindus ruler's troops emotions ran high.Groups from Waziristan traveled hundreds of miles with their own weapons to prevent the massacre.Thousands of Tribal warriors went to occupied Kashmirs to save the honor and dignity of the fellow Muslim brothers against barbarism of Hindus.

Waziristan became part of the new nation of Pakistan.It had virtually no schools.Hospitals or development schemes.poverty there was perhaps the highest and literacy the lowest in the country.Because political parties wee prohibited in the Tribal areas and outsiders were forbidden to enter the entire region was kept outside mainstream political and cultural developments.(58)

How tribal people stood tall & boiled their blood to save Kashmir's Muslim Brother to stemmed Kashmir's slaughter conversely how we treated them first we deserted them and then threw them in the pit of fire against the unmanned warfare.

Another setting example of Treachery committed by our Governments for not to assist the tribal People against US drone strikes.

"North Waziristan's Wazir taliban headed by Hafiz Gul Bahadur Pakistan considered Bahadur's group the "Good" Taliban as they maintained a lasting peace treaty with the government in contrast on other tribes.Drone strikes jeopardized agreements between Pakistan and the tribes, so much so that in March 2011.Bahadur threatened to pull out of the peace talk altogether after one of his top commanders.Sherabat khan wazir a key pro-Pakistan leader of the Wazir Taliban was killed in a drone strike in Datta khel North Wazrisitan along with forty three other people".

US media never shown the image of the dead and wounded person in war that would evoke the feelings of empathy.Pictures of torture from Abu Gharaib Jail to Gauntanamo Bay jail did not appear,For many years the coffins of the dear US soldiers could not be photographed. and although thousands of people have been killed maimed by US drone strikes,Noor Behran has photographed hundreds of drone victims.While his photos appear in media outlets all over the world,there is a virtual blackout in US media

Yet the US did not share complete facts and figures of the combat drone killings.

A 2010 survey of 1,000 tribal people in 20 villages to all seven tribal agencies in FATA, received that Tribal people are suffering with the lack of jobs,transportation's,good roads and lack of access to healthcare and basic education system all along with lack of drinking water in FATA.Tribal believed that US Drone strikes in their area which approximately killed 48% of their own FATA civilians.Report also said that 70% of the country is impoverished.(63) (64)

Chapter # 4

Human Right treaties against any use of force to an another state without the consent  of attacked nation is a u violation of Human rights and UN agenda.

According to the UN Charter Any use of force on the basis of self-defense on the territory of another state to neutralist terrorist without the consent of the attacked state in a violation of Article 2 (4) of the UN Charter& can only be justified if the charter itself is amended.Article 2(4) of the UN charter,along with the categorical repudiation of intervention into another state's affairs as expressed in Article 2(7) (65.66). Apart from condemning acts of terrorism & determining them to be threats to International peace & security, the resolutions made no reference to the right to use force in self-defense,even when Al-Qeada had admitted responsibility for the commission of the attacks.(67)

Many eminent western scholars of international law somewhat impetuously determined the Taliban's responsibility for the events of 9/11 either on the basis of dubious facts or unsound reasoning (68) 

One must reject any US justifications for attacking such groups unilaterally on the premise of fighting global terrorism.Furthermore concurrent with a state's use of force in the UN regime is the duty of this state to approach the UNSC for assistance in resolving the matter as well.

The United state cannot justify the legitimacy of its drone attacks on Pakistan territory on the basis of self-defense.Even if one were to assume that such use of force a legitimate.United states is still required to comply with the customary international law requirements of immediacy,necessity and proportionality under the Caroline paradigm. (69). Additionally the casual manner in which the US government seems willing to target individuals on the basis of no specific evidence or where there is no evidence suggesting that he has renounced or abandoned such activities (70). Secret agreements between states therefore are legally questionable in the context of international law and even if such an agreement granting the US.The consent to conduct lethal drone strikes on civilian targets in Pakistan existed it would suffer from a lack of legal value under established international law (71).

These means include among others approaching the ICJ or the UNGA or other UN bodies to have the US's drone program be declared illegal or to involve the UNSC to bear pressure on the U.S from carrying out further attacks or to shoot down drones should they violate Pakistani airspace (72). Article 51 of additional protocol I,which relates to avoiding civilian causalities by distinguishing military targets in armed conflict,clarifies Article 6 of the ICCPR.(73)  

Under General comment 29,The HRC implicitly rejected the view of the US that the ICCPR does not apply in an armed conflict,otherwise there would be no need to address the issue of derogation for article 4 of the ICCPR. (74)

Contravention of IHRL by the US & Pakistan a reality ?

It has been conclusively established in the preceding section of this chapter that IHRL applies in tandem with IHL.In the application of IHRL norms to US drones strike there are no explicit conflicts between the two bodies of law.Nevertheless,the US is arguably exploiting the ambiguity in international law-as expressed in many reports by Human right organizations.As to which body of law is applicable.Thus,it is important to emphasize that both IHL & IHRL are applicable to US actions which regards to the Drone strikes in FATA,  & the US can't divest itself of its obligations under international law through legal lacunae.(75) .US can be & should be held accountable for violations of HR treaties & customary norms customary norms extraterritorial & in times of armed conflict and peace.(76)

 IHRL (International Human Rights law is comprises of four many treaties (ICCPR,CRC,CAT & the CEDAW). The use of force itself, in the form of drone strikes in FATA is contrary to international law in the sense that the targeting of non state actors through extraterritorial force is only justified in the instance where the actions of the group concerned are imputable to the host state (77)

The drone strikes in Pakistan can constitute first of all arbitrary killings that contravene IHRL norms.The prohibition against arbitrary killings us reflected in specific treaty obligations and forms part of the customary international law.(78). Living under Drones report has posited that "targeted killings as typically understood (international & premeditated killings) cannot be lawful under IHRL (79)

Drone attacks can themselves constitute torture or at a minimum can amount to cruel & unusual punishments as they correspond with the "severe pain or suffering.whether physical or mental,is intentionally inflicted"Article 1 of the CAT defines that " Cruel,inhuman or degrading treatment or punishment" should be interpreted in light of the cruel & unusual treatment & punishment prohibited by the  Fifth,8th &/ or 14th amendments to the constitutions of the US. (80)

There is an obligations on the Pakistani State to protect its citizens from HR violations & to investigate any report of civilian deaths due to Drone strikes (81)

The right to compensation is guaranteed under international law in the case of a violation of IHL or HR,states are "required to provide victims with adequate effective & prompt reparations for the harm suffered which can take the form of restitution,compensation.rehabilitation,satisfaction & guarantees of non-repetition (82). Arbitrary killings directly challenge the right to life & access to justice the unique constitution and cultural practices of the FATA region has meant that the drone strikes, & their lasting psychological impact have prevented the exercise of certain political social & economic rights.General comment 31 of the HRC establishes the right of compensation under the ICCPR (83)

The Drone strikes have a lasting psychological impact on the residents of FATA with children being particularly vulnerable to such impact.The threat of looming Drone predator over Waziristan has meant  that residents of these areas now avoid meeting in large groups & gatherings.Which not only disrupts the social life of the region,protected under the ICESCR.Drones strike prevents the exercise of the rights to assembly & peaceful gatherings guaranteed under the ICCPR.This is even more horrific and mere problematic considering the fact that prayers in mosque take place in congregations.Which leaves many residents fearful of even going to mosques.(87) 

Freedom of movement is guaranteed under Article 9 of the ICCPR.The drone strikes have had serious implications for the movement of women,girls,boys & the elderly outside their homes & villages, The movement is also hampered by the limited transport links & constant violence.(88)

It is a duty of Pakistani state to provide legal redress to the victims of the drone strikes,but also that the Pakistani constitution "enshrines a range of fundamental rights" into domestic law,many of them similar or corresponding to Pakistan's international human rights obligations under for e.g IHRL (89).Under Article 199 of the Pakistani constitution as victims of drone strikes are citizens of Pakistan, the superior courts in the future might be able to exorcise jurisdiction to protect & ensure implementation of their fundamental rights currently not available to FATA under Article 247 of the Pakistani Constitution.Dealing directly with drone strike on Pakistani territory,the Peshawar High Court ruled that drone strikes on Pakistani soil are a violation of the country's  sovereignty breaching the UN Charter.(90,91)

There is no training and no mechanism whereby it can be verified that the individual manning these drone actually do receive proper military training or whether or not their decisions.In comparison to pilot-operated plane the operator watch the ground reality before hit the target.Drone strikes is like a video game where operator kill joy enemies.Precision is inclusive of the manner in which the drone is used & the legality of drones can be problematical as due to the location of the strikes.There are almost civilian causalities.(92)

U.S aggressive extremely open-handed policy to potentially include civilian targets at its discretion.This is evident in how the US has used unlawful combatant.(93). Violent movement of Drones attack not only violate the basic principles of International Human Rights.But also challenge the categories within its own precincts.Drones fatal strikes in FATA have killed thousands of innocence children,women and other civilians.These acts can potentially be deemed a violation of the principles of distinction military necessity & proportionally.By killing those not directly involved in hostilities and by using unnecessary use of force with weapons that do not distinguish between combatants & civilians,all the principles of IHL have been implicated.(94)

A case was filed against CIA officials in the Peshawar High court.This case implicated US authorities,particularly the CIA, in the crime of killing civilians & for causing considerable damage to property through its drones operations(95).Peshawar High Court verdict." Peshawar High court judgement strongly condemns drone attacks as a violation of  IHL & Human rights law.The verdict is based upon 22 pages.(96)

The first court case was appeared against the anti drone strike was the Kareem khan case.Where the claimed sought redress for the killing of his son & brother in a U.S drone strike on 31 December 2009.(97) Laterly Pakistan anti drone activist Kareem khan.the claimant himself was abducted from his abode,interrogated tortured being dumped near Islamabad.The men who seized him wore police uniforms who seems to be a Pakistani agency work.(98)

"Living Under Drones" : Brought fear,injury, Trauma & Death to civilians from US Drone Practices in Pakistan.The report shows the negative impact of US policies on the civilians living under drones strike in FATA Tribal region.Two successive teams of students & faculty conducted field research in Pakistan where they met more than 70 drone-strike survivors & closed relatives of those who killed by drone attacks.Overwhelming majority of the people of FATA & North Waziristan were living under fear & unsaved.(100)

The first public uprising in North Waziristan was held on 17 March 2011 in response US drone strikes on Datta Khel  North Waziristan that killed 44 people and led to widespread condemnation in Pakistan (101) .Tribal heads with thousands other share the  meeting near Miranshah to compensate for the dead and an immediate stop to the drone attacks. In 2013 Drone victim was flown to US dramatically and presented infront of US congress.Harrowing details were presented with personal anguish heard on the floor of congress.Despite that fact the series of adventurous drones strike continued until 2018.(102,103)

Chapter # 6

 

Number of ways Pakistan could exert the pressure to US to prevent drone strikes but Pakistan didn't.

There were numbers of way that Pakistan had to exert the pressure to US to prevent the Drones strike program within Pakistan.Pakistan possessed both political & legal remedies at the domestic & international levels.As a non permanent member of (UNSC) Pakistan had an ideal platform where Pakistan can lifted up her voice.US would have had in a difficult position to defend its position on lethal deadly drones strikes within the framework of the UNSC.Pakistan could argued that it is a violation of its territorial integrity & political Independence protected under Article 2(4) of the UN Charter.US would be harried to justify its drone strikes as self-defense under Article 51,which ostensibly enables the use of force in foreign territories. 

 Article 51 said that state is obliged to officially report to the UNSC that it is acting under this provision.Since US is a permanent member of UNSC that will likely to Veto any UNSC resolution on the issue of Drone strikes into Pakistan.But if Pakistan forwarded such resolution against Drone strikes in Pakistan it could mount a pressure on US and can could create the greater international awareness of the matter to the world and could possibly generate adequate domestic and International pressure to halt the attacks or at least lessen their frequency. 

Under Article 36 (1) of the statute of the International court of Justice (ICJ) a com-promissory clause.Pakistan may also invoke the contentious jurisdiction of the (ICJ) by virtue of a treaty with the US through the US withdraw from the compulsory jurisdiction of the ICJ after the Nicaraguan case. 

Pakistan also had the option to push for an advisory opinion of the ICJ.The court in this regard would require Pakistan to soften & perhaps even revise its legal position on the matter in order to get other states on board and to successfully proceed with the case.

In addition to that Pakistan could pursue the matter in various specialized UN bodies.Pakistan had recently become a member of UNHCR & could raise the issue of drone attacks. at the forum or atleast could facilitate the declaration of a General Assembly Resolution  to condemning drone strikes.

Pakistan had an option of invoking a few human rights treaties in which several were ratified & signed by the US herself including the Convention against Torture & other cruel,inhuman or Degrading treatment or punishment (CAT).(ICCPR) International covenant on civil and political rights.Which guarantee the jurisdiction of the Human Rights Committee,objections to the US drone program can still be raised at the (HCR).

Chapter # 7

Reason of failures to prevent Drone Strike

Pakistan could have stopped the drone strikes but it deliberately allowed US to carry out drone strikes against own civilians.But why Pakistan as a Nation didn't stand upright against the strong bulwark of US oppressor ? Yet another mystery in shrouded or may be an alignment with their corrupt leaders firmly and disregard the cries of native blood.

1.Pakistan's Army,leaders,Generals,decision makers,think tanks,civil service Ministers,Bureaucrats and executives who wield decision making authority in such matter were acutely understaffed lack of competent expertise in the area of law & policy.

2.US Military assistance incessantly  provided to Pakistan's government which was misspend by the Military regime.Corrupt military leader like General Pervez Musharraf took full advantage of US aid and became a multi-billion dollar man.His bank account  increased to 2156 billion dollars.So you may understand the peak of corruption during in his era.While MR 10% (Ex Pakistan's President Zardari) a leader of Pakistan People's Party looted much more money than his military predecessor.Why would  these corrupt rulers save the Nation integrity from the US terror attacks when they were constantly receiving the price money to happily slaughter natives.In fact Musharraf and Zardari were wanted more drones strikes in Pakistan so as to gets more funds by U.S.As a matter of fact they condemned the drone strikes in the national assembly on the other side they love to see  more drones strikes in a country.

3.Pakistan's bureaucracy arising out of the British imperialism.They operate in such a way that their ancestors did it to the colonialism.The bureaucrats  are incredibly self-assured.They didn't pay much attention towards the collateral damage in Pakistan.

 4.Pakistan Political administration is throng with the feudal lords who mainly run their businesses from agricultural to industrial tycoons.These individuals are generally incapable of making strong decisions in Pakistan Politics.Politically as well as Bureaucratic institutions of Pakistan failed to utilized experts  in their decision-making.The state of affairs further deteriorated by the involvement of Military establishment & national security agencies in foreign policy matters.Including the devastated issue of Drone Strikes.

 5.The response of the Nation were very unfortunate and so despicable.Majority of Pakistani people did not do as they should have done against the oppression of their people,but they supported the US drone strikes and believed in a media lies of having killed 5 or 4 terrorist in every drone attack.The cursed of ethnic nationalism never uplifted the nation on single page.No Public Protest and rallies has occurred in any province in support of solidarity to the victimized people.We as a nation became dead.Only few Political Parties like (PTI,Jamaat I Islami & JUI-f) had launched anti-drone protests.While (PPP,PMLN) two major political parties of Pakistan never staged the public protest against US drone strike.

6.The US war on terror seemed to be less about the US and more about the Pakistani media who dauntling support US warfare.Majority of Pakistani media channels runs by Shia and Secular lobby who never wanted to show the atrocity committed by US.Hence they concealed the fact as much as they can and published fake news that has been ordered by the establishment and United States.to show.Media's tactically deceived common citizens perception when they reshaped people's mind with fabricated news.Whenever United States carried out terror attacks inside Pakistan  in which civilians were injured or killed, the media immediately called them terrorists so that, people will ignore the news.Media mainly showed the death toll as low whenever US drone strike  killed more people.Hypocrisy and biased media never spoke the truth and divulged the perennial situation inside tribal areas.

Conclusion

In the end, I will say that the role of the Pakistani government was dreadful against indigenous people .Media played an awful role and indifference of the people themselves were the sole responsible of US drone strikes in Pakistan especially under the umberalla  of sectarianism and ethnic nationalism.
